New codes enable hire-and-fire and permanent temporariness: CITU

The rise of the gig economy has brought about a significant shift in the way people work. With the advent of technology, more and more individuals are turning to gig and platform work as a means of earning a living. However, this new form of employment has also raised concerns about the lack of social security benefits for these workers. In response to this, the Indian government has introduced the Social Security Code, which includes sections 109-114 that specifically address the needs of gig and platform workers.

The Social Security Code, which was passed by the Indian Parliament in September 2020, aims to provide social security benefits to all workers, including those in the gig and platform economy. These sections of the code focus on creating schemes that cater to the unique needs of gig and platform workers, without imposing mandatory timelines, defined benefits, or allocations.

One of the key features of these sections is the creation of a social security fund for gig and platform workers. This fund will be used to provide benefits such as health insurance, maternity benefits, and life and disability cover. The fund will be financed by contributions from the central government, state governments, and the workers themselves. This will ensure that gig and platform workers have access to social security benefits, just like any other worker in the formal sector.

Another important aspect of these sections is the provision for a gig and platform worker welfare board. This board will be responsible for implementing the schemes and ensuring that the benefits reach the intended beneficiaries. It will also act as a platform for gig and platform workers to voice their concerns and grievances. This will help in creating a more inclusive and supportive environment for these workers.

One of the major concerns for gig and platform workers is the lack of a fixed income and job security. The Social Security Code addresses this issue by introducing a gig worker welfare scheme. Under this scheme, gig workers will be entitled to a minimum wage, which will be determined by the central government. This will provide a sense of stability and financial security for gig workers, who often face uncertainty in their earnings.

The code also recognizes the importance of skill development for gig and platform workers. It includes provisions for training and upskilling programs, which will help these workers enhance their skills and improve their employability. This will not only benefit the workers but also contribute to the growth of the gig economy as a whole.

Moreover, the Social Security Code also takes into account the changing nature of work in the gig economy. It acknowledges that gig and platform workers may have multiple sources of income and may not have a fixed employer. Therefore, the code allows for the portability of benefits, which means that workers can carry their social security benefits from one gig to another. This will ensure that these workers are not left without any social security cover when they switch jobs.

The introduction of these sections in the Social Security Code is a significant step towards providing social security benefits to gig and platform workers. It recognizes the contribution of these workers to the economy and aims to provide them with a safety net in times of need. This will not only improve the lives of gig and platform workers but also contribute to the overall growth and development of the country.

It is also worth noting that these sections do not impose mandatory timelines, defined benefits, or allocations. This is a positive aspect as it allows for flexibility and adaptability to the changing needs of gig and platform workers. It also ensures that the schemes can be tailored to suit the specific requirements of different types of gig and platform work.

In conclusion, the Social Security Code sections 109-114 are a welcome move towards providing social security benefits to gig and platform workers. These sections recognize the unique challenges faced by these workers and aim to address them in a comprehensive and inclusive manner. With the implementation of these schemes, gig and platform workers can now have access to social security benefits, which will provide them with a sense of security and stability in their work. This will not only benefit the workers but also contribute to the growth and development of the gig economy in India.
